THE EMPLOYMENT EQUITY REPORT SUBMISSION DEADLINE IS IMMINENT

The submission of the annual 2022 employment equity report by designated employers opened on 1 September 2022.

The manual reporting closing date was 1 October 2022.

A designated employer means –

(a) an employer who employs 50 or more employees;
(b) an employer who employs fewer than 50 employees, but has a total annual turnover that is equal to or above theapplicable annual turnover of a small business in terms of Schedule 4 to this Act;
(c) a municipality, as referred to in Chapter 7 of the Constitution;
(d) an organ of state as defined in section 239 of the Constitution, but excluding the National Defence Force, the National Intelligence Agency and the South African Secret Service; and
(e) an employer bound by a collective agreement in terms of section 23 or 31 of the Labour Relations Act, which appoints it as a designated employer in terms of this Act, to the extent provided for in the agreement.

Schedule 4 of the Act sets out a table with the specific industries’ total annual turnover values, which when met or exceeded, are required to submit an employment equity report in terms of Section 1 (b). 

Employers are alerted to the deadline for the online employment equity report submissions which is midnight on 15 January 2023.

Failure to abide with the provisions of the Employment Equity Act may result in the imposition of fines.
